The next edition of Crossflow will be coming out in late September 2017. Moving forward, Crossflow will continue to be a quarterly digital e-newsletter.

Crossflow is a forum for our membership and we want your input and feedback.

We encourage OSM members and Associate Members to contribute news stories about their businesses. These stories can include things such as interesting projects that are underway or recently completed, new products being fabricated or sold, announcements of new design, fabrication and installation capabilities, community and charitable involvement, awards and achievements, employment announcements.

We also want to hear from members if there are any topical issues you would like us to report on and for the local associations to tells us about events happening in their areas.

2016 Ontario Sheet Metal Apprentice Competition – Windsor, Ontario.

The 2017 Ontario Sheet Metal Apprentice Competition will be held in Windsor from September 27 to September 30, 2017

The competition celebrates the achievements made by OSM and the OSMWRC towards the development of a skilled workforce.

Employers, and particularly those with an apprentice competing, are encouraged to watch the competitors construct the practical project on Friday September 29 and attend the awards dinner on Saturday September 30.

The support and attendance by Employers is very meaningful to the competitors.

An OSM member may attend the awards dinner and receive double occupancy room accommodation at Caesars Windsor Hotel on Saturday night FREE of CHARGE.

Sub-Contracts.

OSM highly recommends that Employers tendering sub-contract fabrication stipulate on Requests for Quotations and on all Purchase Orders, that materials must be compliant with the Provincial Collective Agreement and, that all shop fabricated materials have yellow labels affixed to each item.

This stipulation ensures products have not been fabricated out of province, under production worker agreements (Blue Label) or by non-union. Yellow labels are serial numbered and can be traced to the source of fabrication.

FALL ARRESTORS (Rope Grabs)

Changes are coming in the next edition of:
CSA Z 259.2.5 (2017)
Fall Arrestors and Vertical Lifelines

The new revised CSA standard will include a requirement that all rope grabs (fall arrestors) have an integrated lanyard of no more than 30” (when attached to the dorsal D-ring) of a full body harness. This means that all CSA approved rope grabs will be sold with a lanyard permanently attached that is no longer than 30 inches.

IHSA voted against this for various reasons and is in discussion with CSA regarding the effect on safety performance. Both CSA and IHSA are asking for input on how a 30” integrated lanyard will affect the safety performance of work in your sector.

With consideration for the impact this will have on you and our industry, please send your comments on letterhead, identifying your concerns to:

NEWSBREAK! Working at Heights

The deadline is being extended to October 1, 2017, lengthening the transition period by six months in specific circumstances.

The worker(s) in question must have completed fall protection training that met the requirements of section 26.2(1) of O. Reg. 213/91 (Construction Projects) before April 1, 2015, and the worker must be enrolled in a WAH training program that will be completed before October 1, 2017. The employer must have written proof of enrollment, which must be made available to an inspector upon request.

The proof of enrollment must include the name of the worker, the name of the approved training provider, the date on which the approved training is scheduled to be complete, and the name of the approved training program. Your clients may request you provide them with this proof of enrollment with these four required items.

The Ministry will continue to enforce all occupational health and safety training requirements, including those for working at heights.

The Ontario Sheet Metal Contractors Association (OSM) represents approximately 400 unionized Sheet Metal Contractors within the Province of Ontario. OSM members employ 9000 members of the Sheet Metal Workers International Association (SMWIA). OSM is not in support of Schedule 17 within Bill 70. Schedule 17 of This Bill conflicts with the mandate of the Ontario College of Trades (OCoT) and its rightful oversight over compulsory trades with respect to public safety and scope of practice…

OSMCA and Progressive Certified Trades Coalition against Schedule 17 of Bill 70.

Background Information:

The Liberal government has introduced amendments to the Ontario College of Trades and Apprenticeship Act (the Act) that will dilute the enforcement powers of the Ontario College of Trades and devalue a Certification of Qualification and the compulsory trades designation. LU235 Union Dues Deductions

Please find included letter issued to Sarnia Employers by LU235.

The letter explains payroll deductions and remittances effective June 2016.

It should be noted that the hourly union dues deduction for Sarnia has been reduced from $1.74 to $1.54 and as such the hourly dues deductions are equal with dues deductions for Windsor and Chatham areas.

It should also be noted the $1.54 hourly dues as referenced in the LU235 letter is the combined total of the $0.24 Conference Dues Promotion Trust Fund and the $1.30 Union Dues Promotion Fund. Refer to Note #1 of the wage rate schedules of Appendixes A, G, M as issued within OSM Bulletins #19-16 & #24-16.

Ontario Apprenticeship Training Tax Credit

In the 2015 Ontario Budget, the government announced several changes to the Apprenticeship Training Tax Credit. The proposed changes were enacted through Bill 91, Building Ontario Up Act (Budget Measures), 2015 which received Royal Assent on June 4, 2015.

The apprenticeship training tax credit is a refundable tax credit. It is available to employers who hire and train apprentices in certain skilled trades during the first 36 months of an apprenticeship program that commenced on or after April 24, 2015.

Revised Union Dues Promotion Fund

 

The Ontario Sheet Metal Workers Conference has determined to increase its Conference Dues Promotion Fund by $0.02. This increases this fund from $0.22 to $0.24 and is reflected in the accompanying local union rate sheet notes section. This increase is applicable to all union locals and is effective as of December I, 2015

The members of SMWIA Local 562, Waterloo/Wellington have voted to increase their UDPF for all classifications by $0.03. This increases this fund from $1.52 to $1.55 and is reflected in item 1 of the accompanying Local rate sheet notes section. This increase is applicable to Local 562 Appendix “L” and Appendix “A” as it relates to Waterloo/Wellington only and is effective as of December I, 2015

The members of SMWIA Local 437, London have voted to increase their UDPF by $0.25. This increase will be prorated for apprentices. This increases this fund from $1.06 to $1.31 and is reflected in item 1 of the accompanying Local rate sheet notes section. This increase is applicable to Local 437 Appendix “D” and Appendix “A” as it relates to London only and is effective as of December I, 2015

Prompt Payment Contractor Survey

Prompt Payment Ontario is conducting a survey of contractors with regard to prompt payment. The survey will be administered by Ipsos Reid conducting between 200 to 250 phone interviews and by online survey. The questions asked will be identical for both the phone interviews and online survey.

Executive Director Succession

We are pleased to inform you that the Board of Directors of the Toronto Sheet Metal Contractors Association and the Ontario Sheet Metal Contractors Association have approved Mr. Darryl Stewart to replace our current Executive Director Mr. Wayne Peterson.

It is anticipated that Wayne will be retiring from his Association duties a month or two after the 2016 round of labour negotiations. Effective September 8, 2015 Darryl will be shadowing Wayne and slowly taking over his duties.

Darryl has an extensive sheet metal industry background advancing from a red seal tradesman to the general manager of one of Toronto’s larger sheet metal contracting firms.

We welcome Darryl and as members please provide Darryl with your support as he steps into his new endeavor and moving our Associations into the future

Carman Presti – Obituary

We regret to inform you that Carman Presti passed away on Sunday, June 28, 2015.

Carman was the owner and president of Millprest Sheet Metal Co. Ltd. in Stoney Creek.

Carman was a long-time member of the Brantford/Hamilton/Niagara Sheet Metal Association and served on the OSM Board of Directors for six years prior to his retirement in 2009.

The family will receive friends at the Vineland Chapel of Tallman Funeral Homes, 3277 King Street, Vineland on Tuesday from 7-8:30 pm and Wednesday from 2-4 pm and 7-8:30 pm. The Funeral Service will be held at the Vineland Missionary Church, 3874 Victoria Avenue, Vineland on Thursday at 11 am.

We extend our sincere condolences to Carman’s family.

Stanley “Bud” Broadfoot

We regret to inform you that Stanley “Bud” Broadfoot passed away on Thursday, March 19, 2015.

Bud was owner and president of J.A. Brownlee Ltd. for over 50 years. Bud provided inspiration to many apprentices. He took the time to assist those that worked with him to become leaders.

Bud served on the OSM Labour Relations Council for many years.

Friends will be received by the family at JOHN T. DONOHUE FUNERAL HOME, 362 Waterloo Street at King Street, London, on Monday, March 23 from 2-4 and 7-9 pm. The funeral service will be held on Tuesday, March 24 at 11 am.

In memory of Bud donations may be made to the Salvation Army or the London Food Bank.

We extend our sincere condolences to Bud’s family.

Court Of Appeal Decision Ellis-Don.

Last week, the Court of Appeal allowed an appeal brought by the Ontario Sheet Metal Workers’ Conference and IBEW from a decision of the Divisional Court involving these unions and EllisDon. As a result, the 2012 EllisDon decision of the Ontario Labour Relations Board has been restored.

EllisDon is once again bound to the Ontario Sheet Metal Provincial Collective Agreement and is obliged to subcontract sheet metal work only to signatory sheet metal contractors. But this obligation to subcontract to signatory contractors applies only to projects on which EllisDon made a firm and irrevocable bid on or after February 13, 2014. Oorder to enforce EllisDon’s obligation to use only signatory sheet metal contractors we need to compile comprehensive information about all work being performed by or for EllisDon in our jurisdiction. After we have that information, appropriate inquiries can be made about whether the work was bid before or after February 2014 and whether signatory sheet metal contractors are being used on those projects.

Please assist by providing the Association with whatever information you have about work that was “irrevocably bid” by EllisDon (i.e. before or after February 13, 2014) and work performed or to be performed by EllisDon in the Province after this date.

Wanted Association Executive Director

The Ontario Sheet Metal Contractors Association and the Toronto Sheet Metal Contractors Association are organizations of contractors whose affairs and activities are controlled by a Board of Directors comprised of contractor members or their appointed representative.

We are currently looking for a qualified candidate to fill the role of Executive Director.

The Executive Director will report to the Board of Directors of two associations, and will be a proven leader and manager with well-developed administrative, human resource, financial and strategic partnering experience, as well as the ability to develop and apply strategies that ensure the goals and objectives of the associations are met.

Our preferred candidate will have excellent verbal and written communication skills, relevant industry sector experience with strong relationship based government and member interfaces ability. A technical background in the industry including professional qualifications and experience in media relations would be an asset.

Salary will be commensurate with experience.

 

Our current Executive Director will be retiring after the 2016 Labour Negotiations and we are currently searching for his replacement. It is anticipated that we will be hiring his replacement in the summer of 2015 to allow for a period of orientation.

Provincial Collective Agreement 2013 – 2016

The rate sheets reflecting the increases to the Industry Funds as advised by our Bulletin #13-14 were emailed or mailed to you. You can also view the rates on the website. Note! There is no change to the London Industry Fund.

Also reflected in the revised rate sheets are the following:

  • Local 537 – Brantford, Hamilton, Niagara has increased its U.D.P.F. for all apprentice classifications 2nd year through 5th year. This increase has been offset by hourly rate reductions.
  • Local 235 – Windsor/Chatham has increased its U.D.P.F for all classifications. Note! Local 235’s U.D.P.F. does not appear on the rate sheets but under Note 1.
  • Local 473 – London has reduced its building fund, increased its U.D.P.F and has revised its union dues. These items do not appear on the areas rate sheets. Contact the Local for further clarification.

Canada-Ontario Job Grant

Earlier this year Ontario signed a Job Fund Agreement with the Federal Government. This agreement known as the Canada-Ontario Job Grant (COJG) will provide direct financial support to individual employers who wish to purchase training for their employees. The COJG is available to small, medium and large businesses with a plan to deliver short-term training to existing or new employees, and will:

  • Provide up to $10,000 in government support per person for training costs.
  • Require employers to contribute one-third of the total costs. There will be additional flexibility for small businesses to provide an in-kind contribution towards their share of the costs.
  • Require training to be delivered by an eligible, third-party trainer.

Please TAKE NOTICE that the Annual General Meeting of Members of the Ontario Sheet Metal Contractors Association will be held at 9:00 a.m., Tuesday, April 8, 2014, at The Westin Key West Resort, Key West, Florida, for the purpose of:

  1. receiving the financial statements and report of the auditors for the fiscal year ending December 31, 2013;
  2. appointing auditors, and authorizing the Directors to fix their remuneration;
  3. considering and, if thought fit, approving and ratifying all acts and proceedings of the Board of Directors and of the Officers of the Group since the last Annual General Meeting of Members as set forth or described in the minute books and/or in the financial statements of the Group;

  6. receiving reports on other Association activities and programs;

SMACNA OSM Umbrella – Five Regional Chapters Industry Fund Increase

The OSM Board of Directors has for several board meetings discussed membership in SMACNA. The Board perused the pros and cons of this membership. The Board members agreed that there were certainly a numbers of pros and no cons with the exception of the cost. Some efforts were made to determine a reasonable cost for the value of SMACNA membership and relying on the Toronto member’s experience it was determined that $0.05 was reasonable.

Through our Executive Director, negotiations were conducted with SMACNA where an agreed to fee of $0.05 per manhour was reached. This fee is based on all industry fund hours plus a $200 yearly membership fee for those contractors signing a SMACNA membership form. This $0.05 hourly fee would be in place until 2019 with further negotiation to take place at that time relating to any increases. The hourly fee is in Canadian funds and is 37.5% less than other SMACNA Chapters in Canada were scheduled to pay as of January 1, 2014.

Membership benefits experienced by the Toronto SMACNA chapter:

  • Owners requiring the successful contractor to be a SMACNA member (two instances)
  • With SMACNA design assistance and consultation contractors were able to save significant dollars with alternate HVAC designs.
  • On request, SMACNA Technical Department got directly involved with a call to a projects design authority who was disputing the contractor’s duct design and installation meeting SMACNA standards as specified.
  • A number of contractors have successfully used SMACNA’s Manhour Productivity Rates to justify change notice labour hours.
  • Contractors who have attended SMACNA education programs have attested that the programs they attended have led to better project management skills and a better understanding of the necessary financial management of their firm.
  • A closer relationship with the design community as well as the Building Department officials has been achieved.
  • A higher profile for the Association and an acknowledgment of our contractor members has been achieved.
  • A conduit for input into the Canadian and Ontario Building Codes is now available.
  • Industry related technical presentations – (duct design, seismic restraints, duct construction apps, duct leakage apps).
  • Guess speaker, educational presentations – (SMACNA Labour Units, Project Management Institute, Senior Estimator course).
  • One free copy of all current SMACNA Manuals.
  • One free copy of any new manual or manual revisions.

It is recommended:

  • That under the OSM umbrella we organize five SMACNA Chapters: Eastern Ontario, Central Ontario, Toronto, Western Ontario and Northern Ontario.
  • OSM would be the coordinating body for all SMACNA guest speakers and technical presentations working with the five regional chapters.
  • Increase our OSM Industry Fund from $0.13 to $0.18 and with consideration of our current by-laws dues schedule and its capping of the funds, we increase the base fixed rate from $0.01 to $0.06 per hour
  • That the industry fund increase be effective as of December 1, 2014

Prompt Payment Legislation – We Need Your Assistance

We have been lobbying and are still waiting for the Ontario government to move Bill 69 the Prompt Payment Act through the committee process and bring it back for 3rd reading. Everyone deserves to be paid on time for work that is completed and approved – and it does affect everyone in the construction chain. We need to show the government how important this is and how many individuals it affects.

  2. We are hoping to collect more than 50,000 submissions of support. This will show the decision makers at Queen’ Park the breadth and depth of support for prompt payment legislation that exists in our construction industry. So please forward this message to everyone you know who works in the construction industry, contractor or worker, manufacturer, supplier, distributor.

Let’s do everything we can to make sure the hard working people in the construction industry are paid on a timely basis for work completed. If you or anyone you know makes a living in the construction industry – than we ask for your support in changing it for the better.

Accessible Customer Service Policy

The Ontario Government requires all companies to have in place an Accessible Customer Service Plan. This is a requirement for all companies having one or more employees regardless of what business you are in.

Legislation requires firms to create a written plan, train their staff and if they have over fifty employees file their plan with the Government.

Your Industry Standards Committee has drafted a plan template for your consideration and use. This plan is available as a download from the member’s section of our web site.

With training being a requirement of the legislation, the following you tube video provides a tool to meet this requirement:

It is most heartening for an apprentice to be called up to receive his certificate or prize in the presence of his employer.

The Ontario Sheet Metal Workers Training Centre
Is Offering: G3 and GP Courses

The Ontario Sheet Metal Workers Training Centre will offer Gas Fitter courses starting September 21, 2013. If you have an interest in obtaining a gas certificate, please contact us at the Ontario Sheet Metal Workers Training Centre. Course runs for approximately 10 weeks, Monday & Wednesdays from 6:00 pm – 9:00 pm, and Saturday’s from 7:00 am – 2:00 pm. The first course will have an option to run right into our GP program that will follow the G3. We are limited by number of seats, so please contact us A.S.A.P. A deposit of $450.00 is required to confirm your spot, and is reimbursed on completion of the course.

Prerequisites:

  • You must be a member of The Sheet Metal Workers Union, and in good standing.
  • Phase 1 day school completed, or are currently attending schooling.
  • The Natural Gas, Propane Installation Code, Propane Storage Handling Code books, and the Gas Fitters 3 Modules 1-9 will be available for you at no cost during the course, upon completion these materials will be yours. (Value $450.00)

Please be advised that the Ontario Sheet Metal Workers’ Conference and the Ontario Sheet Metal Contractors Association have reached a tentative 2013 – 2016 contract agreement.

This tentative Memorandum of Settlement must still be ratified by the negotiation party’s members and it is anticipated that the outcome of this ratification will not be known until May 9, 2013.

Please be advised that SMWIA Local 30 (Toronto) and SMWIA Local 562 (Waterloo/Wellington) refused to sign the Memorandum of Settlement and hence we are assuming they will be advising their members to reject the settlement.

Applications are now being accepted for the 2013 Wally McIntosh Memorial Scholarship. Two recipients will be named.

The $2000.00 annual entrance award (per recipient) is available to the children of owners, partners and employees of an Ontario Association member contractor. Please inform all your employees of the details of this award. Application form is attached.

Note that the applicant must:

  1. be a son or daughter of an employee of a voting member of the Ontario Sheet Metal Contractors Association.
  2. be graduating from high school and entering a College or University of his/her choice.
  3. achieve a minimum of 75% average on six Grade 12 subjects.
  4. include a recommendation from school principal.
  5. have demonstrated leadership qualities through involvement in extra-curricular or community activities, includes volunteer work.

Attached (separate attachment) please find the evaluation form so the applicant is aware of the scoring system, which is divided into 5 categories.

Preference will be given to candidates whose connection is with persons involved directly with the sheet metal industry.
